Effective immediately, Sealcoat Services, Inc. d/b/a SCS Construction Company is no longer eligible to participate in the NDOR Disadvantaged Business Enterprise Program. Vergene Wallace has retired and sold her ownership in in the firm. NDOR would like to thank Vergene for her many years of participation in the DBE Program and wish her well in her retirement.
As NDOR understands, Sealcoat Services, Inc. d/b/a SCS Construction Company will remain in business and intends to perform all of the work currently subcontracted to them.
If a prime contractor has executed a subcontract with Sealcoat Services, Inc. d/b/a SCS Construction Company before the firm became ineligible, the prime contractor may continue to use the firm on the contract and may continue to receive credit toward its DBE goal for the firm's work.
If a prime contractor has made a commitment to use Sealcoat Services, Inc. d/b/a SCS Construction Company to meet a DBE project goal, but a subcontract has not been executed before the firm became ineligible, the firm’s work will not count toward the project goal. The prime contractor must meet the contract goal with another eligible DBE firm or demonstrate it has made a good faith effort to do so.
